Safe Passing Distance

  • The current safe passing law applies only to cyclists, and requires that motorists give a “safe distance” and use a “reasonable speed” when passing. These terms are undefined in statute, making it difficult for police to enforce.
  • There is currently legislation filed that would define the safe passing distance as a minimum of three feet and increasing the faster that a motor vehicle is traveling.
  • This legislation would also expand the safe passing distance statute to apply all “vulnerable road” users, not just cyclists.
